President Trump’s NLRB has set new precedent for social media policies within handbooks.  No longer will the Lutheran Heritage rule of whether an employee could “reasonably construe” the language of a policy to violate the NLRA be the guide.  The NLRB’s Boeing decision requires that an employer’s interest in providing rules of conduct be balanced against the NLRA’s protection of employee rights.
